Creative Commons-Licensed Works Posted in Scholar Commons

For works posted in Scholar Commons that display a Creative Commons license in their record and/or on the work itself, the use of that work is governed by the terms of the license selected by the content creator. You can find more information on the terms of CC licenses here.

If you are an author looking to deposit works and would like more information on CC licenses please review Considerations for licensors. Once you are ready to add a CC license to your work, you can choose your Creative Commons Licenses with this online tool. If you choose to not add a CC license to your work your content will default to the USF Non-Exclusive License Agreement listed below.

Rights and Terms of Use for Material Posted in Scholar Commons

The contributor grants the USF Libraries a royalty-free and non-exclusive worldwide license to include their work and all associated content, abstracts, tables of contents, reference lists, additional files, and metadata within Scholar Commons. Works deposited in Scholar Commons are electronically stored and disseminated for educational purposes only; this license in no way allows the works to be used for commercial purposes. With the exclusion of this limited license, copyright or any intellectual property rights associated with deposited works remain with the contributor or copyright holder if that entity is separate from the contributor. If submission contains the input from others, the contributor represents that appropriate permission was gained from the copyright owner. If submission is based on or part of work supported by another entity, the contributor represents that she/he has fulfilled all obligations required by such contract or agreement. Contributors agree to share their work and waive any privacy rights granted by international, federal, state, or local law, policy, or regulation with respect to works within the deposit. No modification of this agreement can be made unless submitted in writing and signed by both parties.

For previously published works (journal articles, book chapters, etc.) for which the publisher retains copyright, permission has been granted (where necessary) to post this material on Scholar Commons. For any use that exceeds personal use or the terms of Fair Use, the copyright owner of the material may require permission.

For theses and dissertations, USF holds a non-exclusive license to archive and make accessible the document in all forms of media, now or hereafter known. Scholar Commons is an official USF initiative to showcase the great scholarship being produced at the university and therefore theses and dissertations are included.

For theses, dissertations, or other previously unpublished scholarly or creative works, the right to download or print any portion of this material is granted by the copyright owner only for personal or educational use. The author/creator retains all proprietary rights, including copyright ownership. Publisher Policies

Many publishers will allow you to post a version (pre, post, or publisher) of your work in an institutional repository such as Scholar Commons. Where deposit of the full text is not possible due to copyright restrictions, a record can still be created to display the title, author(s), publisher citation, abstract, descriptive information, and a link to an alternative location, such as the publisher’s version. It may also be possible to work with your publisher to re-gain or request these rights.
